Welcome to HealthySafar (“Company”, “We”, “Us”, “Our”). These Terms & Conditions (“Terms”) govern your access to and use of our website, mobile site, applications, and services (collectively, the “Platform”). By accessing, browsing, registering on, or transacting through the Platform, you agree to be bound by these Terms.

1. Definitions

For the purpose of these Terms:

  • “Company”, “We”, “Us”, “Our” means HealthySafar, operating and managing the Platform.
  • “User”, “You”, “Your” means any person accessing, using, or transacting on the Platform.
  • “Subscriptions / Memberships” means recurring or fixed-term plans, diet plans, wellness plans, loyalty or access plans, or any digital/service-based offerings provided by HealthySafar.
  • “Food Orders” means salads and all perishable, ready-to-eat or ready-to-cook food items ordered via the Platform.
  • “Non-Food Products / Services” means any non-perishable goods or separately identifiable services listed on the Platform (if any).
  • “Working Days” means days other than Sundays and public holidays observed in India.

This Policy forms an integral part of the Terms governing your use of HealthySafar.

2. Applicability

These Terms govern:

  • Your access and use of the Platform;
  • Payments made towards Food Orders, Subscriptions / Memberships and any Non-Food Products / Services;
  • Any request for cancellation, refund, replacement, chargeback, or dispute related to such payments.

In case of conflict, specific plan/offer terms displayed at the time of purchase shall prevail for that purchase.

3. Eligibility & Account Responsibility

  • You must be at least 18 years of age and legally competent to contract under Indian law.
  • You are responsible for maintaining the confidentiality of your login details and for all activities that occur under your account.
  • You agree to provide true, accurate and complete information and to keep it updated.
  • You must immediately inform us if you suspect any unauthorised access or misuse of your account.

4. User Obligations & Prohibited Use

You agree that you will NOT:

  • Use the Platform for any unlawful, fraudulent, or malicious purpose;
  • Place fake orders, misuse offers, or attempt to cause loss to HealthySafar, its partners or riders;
  • Resell, redistribute, or commercially exploit products purchased via the Platform without written consent;
  • Interfere with or disrupt the security, integrity or performance of the Platform;
  • Upload or transmit any viruses, malware, or harmful code.

HealthySafar reserves the right to suspend, restrict or terminate your access if you violate these Terms or act in a manner harmful to the Platform or other users.

5. Currency, Taxes & Pricing

  • All prices are in Indian Rupees (INR/₹).
  • Applicable taxes (including GST, where applicable) shall be levied as per prevailing law and displayed at checkout.
  • HealthySafar may modify prices, fees, offers and discounts at any time without prior notice.
  • The price applicable to your order is the one displayed at the time of completing the payment, subject to successful transaction.

6. Payment Terms

  • Payments must be made through authorised payment methods available on the Platform (UPI, cards, net banking, wallets, etc.), in compliance with RBI/NPCI norms.
  • An order / subscription is confirmed only upon successful payment and generation of an order ID / subscription confirmation.
  • By initiating a payment, you confirm that you are authorised to use the payment instrument.
  • HealthySafar does not store your full card details, CVV, UPI PIN or other sensitive payment data; transactions are processed via secure, PCI-DSS compliant gateways.

7. Refunds, Cancellations & Failed Transactions

Our detailed Refund Policy forms part of these Terms. Key points are summarised below:

7.1 Food Orders (Salads & Perishable Products)
  • Once a Food Order is placed and payment is processed, no cancellation, refund, replacement or modification is allowed, except in limited cases of wrong or unsafe food as per the Refund Policy.
  • If you are unreachable or unavailable at the time of delivery or provide incorrect/incomplete address, the order may be marked delivered and no refund is applicable.
7.2 Subscriptions / Memberships
  • Once activated or once any benefit is used, Subscriptions / Memberships are non-refundable and non-transferable, unless expressly stated otherwise for a specific plan.
  • If payment is made but the plan is not yet activated and no service is availed, you may request cancellation within 24 hours. Any approved refund may be subject to deduction of gateway and administrative charges.
7.3 Non-Food Products / Services

If and when HealthySafar offers non-food physical products or standalone services, refund/return will be handled as per applicable product-specific terms and our Refund Policy.

7.4 Failed, Pending & Duplicate Transactions
  • If your account is debited but no order/subscription is created, please contact us with transaction details.
  • Upon confirmation from the payment gateway, the amount will be either adjusted against a valid order or refunded to the original payment source, typically within 5–10 Working Days (subject to your bank).

8. Chargebacks, Disputes & Fraudulent Use

  • You agree to first attempt resolution directly with HealthySafar before initiating a chargeback with your bank.
  • Unwarranted or bad-faith chargebacks may result in suspension/termination of your account and recovery of consequential losses, fees and legal costs.
  • We may share relevant records (order details, logs, delivery proof) with banks/payment partners or authorities to contest fraudulent chargebacks.

9. Health, Nutrition & Allergy Disclaimer

  • Information on the Platform (including calorie counts, nutrition tips, or wellness suggestions) is for general informational purposes only and is not medical advice.
  • You are solely responsible for reviewing ingredients and ensuring products are suitable for your health conditions, allergies, dietary restrictions, religion or preferences.
  • HealthySafar is not liable for any adverse reactions or consequences arising from undisclosed allergies, pre-existing conditions, or failure to consult a qualified healthcare professional.

10. Intellectual Property

  • All content on the Platform, including logos, trademarks, images, text, graphics, designs and software, is the property of HealthySafar or its licensors.
  • You may not copy, reproduce, modify, distribute, or create derivative works from any content without prior written permission.

11. Limitation of Liability

To the fullest extent permitted by law:

  • The total aggregate liability of HealthySafar for any claim relating to a specific transaction shall not exceed the actual amount paid by you for that transaction (where a valid claim is legally established).
  • HealthySafar is not liable for any indirect, incidental, consequential, punitive, or special damages, or for loss of profit, data, or business opportunities.
  • We are not responsible for delays or failures caused by third-party carriers, payment gateways, internet outages, or circumstances beyond our reasonable control.

12. Indemnity

You agree to indemnify, defend, and hold harmless HealthySafar, its affiliates, directors, employees, agents, and service providers from and against any claims, demands, disputes, liabilities, losses, damages, costs, and expenses (including reasonable legal fees) arising out of or relating to:

  • Your use or misuse of the Platform;
  • Your violation of these Terms or any applicable law;
  • Unauthorised or fraudulent use of payment instruments or your account;
  • False or malicious complaints or chargebacks.

13. Force Majeure

HealthySafar shall not be liable for any failure or delay in performance (including preparation or delivery of orders) arising from events beyond its reasonable control, such as natural disasters, epidemics, strikes, war, government actions, technical failures, or disruptions of communication networks.

14. Modifications to Terms

HealthySafar may amend, update, or modify these Terms at any time. Updated Terms shall be posted on the Platform with a revised “Last updated” date. Your continued use of the Platform after such changes will constitute acceptance.

15. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Subject to applicable law, any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts at Chhatrapati Sambhajinagar, Maharashtra.
